Worried by the ads for "Title lock" services? I am, at least a little bit, but so far not enough to subscribe to the service advertising protection. I contacted Harris County Real Property Records, asking if there was a way to prevent someone from recording a change to my property's ownership. The reply was a bit distressing. Here it is: "The Harris County Clerk's Office is a recording agency that, by statute, is mandated to accept property document filings without discrimination to the public. Still, in instances that we suspect a document is fraudulent, whether submitted electronically or in person, the case is provided to the District Attorney's Office for review.
We are currently exploring ways to mitigate these challenges. But there is currently no application available that can be implemented to catch this type of activity before it happens. The laws that guide property transactions in Texas need to be strengthened by the legislature to allow the implementation of measures to eliminate this type of fraud." Note that last paragraph: "...there is currently no application available that can be implemented to catch this type of activity before it happens." In other words, there is no way to prevent that kind of crime! I sent a message to my state rep and senator, asking if that is something they could bring up in the special session or next year. Also from Harris County Clerk's office I got this instruction for looking up info:
"Please note, you may research our records on our website: www.cclerk.hctx.net. Select "Search Records" at the top right corner of the website. Then hover your mouse over "Property Records" and a drop-down menu will appear where you will select "Real Property". Be sure to search your name as a grantor and then as a grantee. Enter your last name first and then enter your first name before clicking search (no commas). Most document images can be viewed on the website after you create an account. It is not required to create an account to view the index. And the threats just keep on coming!
